These Terms of Service (“Terms”) govern your access to and use of XochiCraft (“we,” “us,” or “our”) and our website and services located at https://xochicraft.com (the “Service”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you confirm that you are legally permitted to enter into these Terms.

To use certain features, you may be required to create an account. When creating an account, you agree to provide accurate and complete information.
You are responsible for maintaining the confidentiality of your login credentials and are responsible for all activity under your account.
3. Use of the Service
XochiCraft provides project management tools that allow users to create, organize, and manage projects and related content.
You agree to use the Service only for lawful purposes and in compliance with these Terms.
4. Prohibited Activities
You agree that you will not:
- Use the Service for unlawful purposes
- Upload malware, viruses, or harmful code
- Attempt to hack, exploit, or disrupt the Service
- Access another user’s account without permission
- Reverse engineer or copy the Service
- Scrape or harvest data from the Service
- Upload content that is illegal, abusive, hateful, or harassing
- Upload content that infringes intellectual property rights
- Upload content that violates privacy rights of others
- Misrepresent your identity or impersonate others
We reserve the right to investigate and take action against violations of this section, including account suspension or termination.
5. User Content (Projects, Files, and Images)
A. User Content Definition
“User Content” includes any information submitted into the Service, including:
- project data
- tasks, notes, and comments
- uploaded files and attachments
- uploaded images, including profile pictures and project-related images
B. Ownership
You retain ownership of your User Content.
C. License to Operate the Service
By uploading or submitting User Content, you grant XochiCraft a limited, non-exclusive, worldwide license to store, process, display, reproduce, and transmit your User Content solely for the purpose of operating, maintaining, and improving the Service.
D. Responsibility for Content
You are solely responsible for your User Content. You represent and warrant that:
- you have the legal right to upload the content
- your content does not infringe copyrights, trademarks, or other rights
- your content does not violate any laws or third-party rights
6. Profile Images and Visibility
If you upload a profile image, you understand that it may be visible to other users within your workspace, team, or shared project environment, depending on your settings and how the Service is used.

We may modify, update, suspend, or discontinue the Service or any part of it at any time.
We do not guarantee uninterrupted availability and are not responsible for downtime, data loss, or service interruptions.
10. Termination
A. Termination by You
You may stop using the Service at any time.
B. Termination by XochiCraft
We may suspend or terminate your account at any time if:
- you violate these Terms
- you misuse the Service
- we suspect fraud, abuse, or unauthorized access
- we are required to do so by law
- we discontinue the Service
11. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis.
To the fullest extent permitted by law, XochiCraft disclaims all warranties, including but not limited to warranties of:
- merchantability
- fitness for a particular purpose
- non-infringement
- uninterrupted or error-free operation
- security or reliability of stored data
12. Limitation of Liability
To the fullest extent permitted by law, XochiCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- loss of profits
- loss of revenue
- loss of business opportunities
- loss of data or project content
- unauthorized access to your account
In all cases, XochiCraft’s total liability shall not exceed the greater of:
- the amount you paid to use the Service in the last 12 months, or
- $100 USD
13. Indemnification
You agree to indemnify and hold harmless XochiCraft, its affiliates, employees, and partners from any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising from:
- your use of the Service
- your User Content
- your violation of these Terms
- your violation of any law or third-party rights
14. Intellectual Property
The Service, including its design, code, features, branding, and logos, is owned by XochiCraft and protected by intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without written permission.
15. Third-Party Services
The Service may integrate with third-party tools or services. XochiCraft is not responsible for third-party services, and your use of those services may be governed by their own policies.

17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
You agree that any legal action or proceeding arising from these Terms or your use of the Service will be brought exclusively in the state or federal courts located in Fresno County, California, United States.
